Corporate Rights or Human Rights ? The case of Investor State Dispute Settlement

This session will highlight the dangerous implications of international investment treaties and Investor-State Dispute Settlement (ISDS) for Southern countries. It will look at the ability of corporations to sue countries in secretive arbitration for huge sums for lost profits when countries try to protect things like the environment or labour rights. These settlements, or the threat of them, create a regulatory chill in countries and result in huge payments that constrain countries’ ability to comply with their human rights obligations. Current initiatives to mobilize and engage people and pressure governments to address this issue will be covered. Inter Pares will collaborate with Focus on the Global South, Trans National Institute and possibly others to present
